Philosophically, the study attempted to establish a philosophical foundation for human rights learning, particularly by examining the freedom of thought and expression according to Spinoza. According to Spinoza, freedom of thought is the primal and intrinsic “supreme natural right” for humans, and to violate it would be to deny freedom and happiness that do not exist above it. Furthermore, for Spinoza, expressive activities are seen as integral to the freedom of thought, constituting an essential activity rooted in one's inherent nature for the pursuit of human happiness. Therefore, Spinoza believed that state control was necessary to maintain the communal nature of humans, who were not always rational, and the purpose of the state is,in essence, to be free.\nOn the other hand, from a political science perspective, the study pointed out theproblem in the current learning of constitutional law where the concept of “popular sovereignty” is understood as entirely fixed and given. As a way to overcome this problem, the study argued that it is not to differentiate between politics and history, but rather to go back and forth between the two to encourage deep insights into the formation and historical circumstances of one's own society. By doing so, we will be able to not only understand the Constitution, but also actively participate in resolving real societal issues and construct its institutional foundation. Furthermore, regarding the study of Constitution and human rights, this study pointed out the negative effects of studying human rights while remaining stuck within the framework of sovereign states.
